Fifteen thousand lawyers practice in Arizona, but there is no requirement that any of them carry malpractice insurance.  While insurance is required in some professions, the practice of law is not one of them.  The first thing we will do when we determine you have a case is to check a data base and ascertain whether the lawyer has insurance. 
If the attorney is insured, policy limits can technically run as low as $300,000, but generally, a policy will have limits of $1,000,000 or more.  When a legal malpractice claim is filed, the insurance company will assign a law firm to defend your former lawyer against your claims. The insurance company will then allocate money to pay the client if the accused lawyer and insurer are not successful in their defense. The amount of money set aside is typically the "value" of the client’s case, as assessed by the insurer.  If the attorney is not insured, we will evaluate whether he or she has sufficient assets to collect against, should a claim be successful.
